OVERVIEW

Welcome to Azuremist. The terms "we," "us," and "our" refer to Azuremist. Azuremist operates this store and website, including all related information, content, features, tools, products, and services to provide you, the customer, with a curated shopping experience (the "Services").

Azuremist is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced herein, including our Privacy Policy, Refund Policy, and any other policies posted on this website, describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, because they include important information about your legal rights and cover topics such as product safety, ultraviolet (UV) light and battery hazards, assumption of risk, warranty disclaimers, limitations of liability, dispute handling, and your obligations when using our Services and products.

By visiting, interacting with, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy located at azuremist.us. If you do not agree, you should not use or access the Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use certain parts of the Services, including browsing, placing orders, or accessing account-related features, you may be asked to provide certain information, including your name, email address, billing information, shipping information, and payment details. You represent and warrant that all information you provide is accurate, current, complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You may not transfer, sell, assign, or license your account to any other person without our prior written consent.

We reserve the right to suspend or terminate accounts, refuse service, or cancel orders if we believe information provided is inaccurate, fraudulent, misleading, or used in violation of these Terms.

SECTION 2 — OUR PRODUCTS

Azuremist offers consumer household and hygiene products. Our current primary product is an automatic UV (ultraviolet/UVC) toilet sterilization and deodorizing device designed to mount in or near the toilet bowl, seat, or lid area, which contains a built-in rechargeable battery and uses ultraviolet light together with optional fragrance tablets to help keep the toilet area fresher and cleaner between manual cleanings (the "Device"). We may also offer related accessories, mounting hardware, charging cables, replacement fragrance tablets, and additional products in the future, all of which are included in the term "products" where applicable.

We make reasonable efforts to display our products and services accurately in our online store. However, colors, appearance, depictions of UV light, illustrations of coverage or sterilization performance, and other visual details may vary depending on your screen, device, settings, and individual perception. All marketing images are illustrative only.

We do not guarantee that the appearance, packaging, performance, runtime, battery life, or quality of any product purchased by you will exactly match how it appears online or meet every subjective expectation.

All descriptions, images, references, specifications, pricing, and availability of products are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and to limit quantities sold to any person, household, geographic region, or jurisdiction.

SECTION 3 — PRODUCT USE, SAFETY, AND CUSTOMER RESPONSIBILITY

You agree to use the Device and all Azuremist products only for their intended purpose and strictly in accordance with all instructions, warnings, care guidelines, safety information, and product descriptions provided on the website, packaging, labels, inserts, or user manual. For the Device, the intended purpose is use as an in-bowl/in-toilet sanitizing and deodorizing aid only.

You are responsible for reviewing all product information, instructions, and warnings before first use and for determining whether the Device is appropriate for your toilet, bathroom, and circumstances.

The Device is an electrical product that emits ultraviolet light and contains a rechargeable battery. Improper use, installation, charging, or handling may result in discomfort, irritation, injury, fire, or property damage. You agree to:

install and mount the Device only as directed in the instructions;
operate the Device only as intended, with the toilet lid closed where the design requires it;
keep the Device out of the reach of children and pets, and supervise use around children, elderly persons, or anyone who may not understand or follow the warnings;
discontinue use immediately and stop charging if you observe malfunction, overheating, swelling, smoke, unusual odor, leakage, water ingress, or any damage, and seek appropriate professional advice where needed.

You agree that you will not:

look directly at, or allow any person or animal to look directly at, the UV light;
expose skin, eyes, face, hands, or any part of the body of any person or animal to the UV light;
use the Device as a handheld wand, or point or direct it at people, animals, skin, food, or any surface other than the interior toilet area it is designed to treat;
disassemble, modify, puncture, crush, short-circuit, or tamper with the Device or its battery;
submerge the Device or expose it to water beyond its stated splash resistance;
use the Device in a careless, excessive, or unintended manner, or continue using it after irritation, injury, malfunction, or damage becomes apparent.

SECTION 4 — UV / ULTRAVIOLET (UVC) LIGHT SAFETY

The Device uses ultraviolet (UVC) light. Direct exposure to UVC light can be harmful. It may cause eye injury (including photokeratitis), skin irritation or burns, and other harm. UVC light is not safe for direct human or animal exposure.

You acknowledge and agree that:

the UV light must never be viewed directly and must never be directed at the eyes, skin, or any part of the body of any person or animal;
the Device is designed to operate within an enclosed toilet area and should only be activated as intended;
you are solely responsible for ensuring that the Device is installed and used so that people and animals are not exposed to the UV light;
you will keep the Device away from children, pets, and anyone who may not understand or follow these warnings.

To the fullest extent permitted by applicable law, Azuremist is not responsible for any injury, harm, or damage resulting from exposure to UV light that is caused by misuse, improper installation, tampering, unintended use, or failure to follow the warnings and instructions.

SECTION 5 — BATTERY, CHARGING, AND ELECTRICAL SAFETY

The Device contains a built-in rechargeable battery. Rechargeable batteries can pose risks of overheating, fire, leakage, or rupture if they are misused, damaged, or improperly charged.

You agree to:

charge the Device only with the cable or charging method provided or specified by us, using a standard, compatible power source;
keep the charging port and all electrical connections dry and away from water;
not charge the Device unattended for excessive periods, near flammable materials, or in any manner inconsistent with the instructions;
stop charging and discontinue use immediately if the Device or battery becomes excessively hot, swells, leaks, emits odor or smoke, or shows any sign of damage;
not puncture, crush, disassemble, short-circuit, incinerate, or expose the battery to high temperatures;
not submerge the Device — any stated water resistance protects only against limited splashing and is not a guarantee against water damage;
store, handle, and dispose of the Device and its battery in accordance with all applicable laws and local regulations.

Because the Device is used in a bathroom environment where water and electricity are present together, you accept responsibility for using it safely, keeping electrical connections dry, and following all instructions. To the fullest extent permitted by applicable law, Azuremist is not liable for injury, fire, property damage, or other harm resulting from improper charging, water exposure, battery misuse, tampering, unintended use, or failure to follow instructions.

SECTION 6 — ASSUMPTION OF RISK AND RELEASE

You understand that the Device is an electrical product that emits ultraviolet light and contains a rechargeable battery, and that purchasing, installing, charging, operating, storing, and using it involves inherent risks, including but not limited to UV exposure, electrical hazards, battery-related hazards, water-related hazards, and risks associated with mounting hardware or adhesives.

To the fullest extent permitted by applicable law, you voluntarily and knowingly assume all risks associated with the purchase, installation, charging, operation, storage, and use of the Device, whether or not such risks are currently known to you, and you agree that you use the Device at your own risk.

To the fullest extent permitted by applicable law, you release and discharge Azuremist and its owners, officers, directors, employees, affiliates, agents, contractors, suppliers, licensors, and service providers from any claims, liabilities, damages, or expenses arising out of or related to your use or misuse of the Device, except to the extent caused by our own gross negligence or willful misconduct, or to the extent such a release is not permitted by law.

Nothing in this section is intended to exclude or limit any right or liability that cannot lawfully be excluded or limited, including, where applicable, liability for personal injury.

SECTION 7 — NO MEDICAL OR HEALTH ADVICE; NO DISINFECTION OR DISEASE-PREVENTION GUARANTEE

Information provided through the Services or in connection with the Device is for general informational and consumer purposes only and is not medical, health, or other professional advice.

The Device is a consumer convenience and hygiene aid intended to help keep the toilet area fresher and cleaner between manual cleanings. The Device is not a medical device. Unless expressly stated by Azuremist in writing, the Device is not intended to diagnose, treat, cure, prevent, or eliminate any disease, infection, virus, bacteria, or medical condition, and it is not a substitute for regular cleaning, disinfecting, hand washing, or professional sanitation.

Any references to sterilization, disinfection, germ reduction, or percentages (such as any "99.9%" or similar figure) describe laboratory-style or manufacturer testing conditions and do not guarantee the same results in your home. Real-world results depend on factors including placement, mounting, surface condition, toilet shape, runtime, and proper use. You should not rely on the Device as your sole method of sanitation or for protection against illness.

If you have allergies, sensitivities, respiratory conditions, or other health concerns that could affect safe use, you should consult an appropriate licensed professional before use.

SECTION 8 — ORDERS

When you place an order, you are making an offer to purchase. Azuremist reserves the right to accept or decline your order in its sole discretion. Your order is not accepted until we confirm acceptance.

We must receive and process payment before an order is accepted. Please review your order carefully before submitting it, as we may be unable to accommodate cancellation or modification requests after acceptance.

In the event that we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided at the time the order was made.

Your purchases are subject to our Refund Policy located at azuremist.us.

You represent and warrant that your purchases are for your own personal or household use and not for unauthorized commercial resale or export.

SECTION 9 — PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time your order is placed and will be set out in your order confirmation, unless there is an obvious pricing or listing error.

Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs duties, or import charges.

We may offer promotions from time to time that are governed by separate terms. If there is a conflict between promotional terms and these Terms, the promotional terms will control for that promotion.

You agree to provide current, complete, and accurate purchase, billing, payment, and account information for all purchases made through the Services. You further represent and warrant that the payment method you use is authorized and that all charges incurred by you will be honored.

We reserve the right to correct any errors, inaccuracies, or omissions relating to pricing, promotions, descriptions, shipping charges, or availability, including after an order has been submitted.

SECTION 10 — SHIPPING AND DELIVERY

Delivery times are estimates only and are not guaranteed unless expressly stated otherwise by us in writing. Some products may be fulfilled by domestic or international suppliers, and delivery may take longer than typical domestic shipping.

We are not responsible for shipping delays caused by carriers, weather, customs processing, supply disruptions, incorrect addresses, or events outside our reasonable control.

Title and risk of loss pass to you upon our transfer of the product to the carrier, to the extent permitted by applicable law.

If we advertise or communicate a shipping timeframe, we aim to have a reasonable basis for that estimate. If an order cannot be shipped within the promised time, or if no time is stated and shipment cannot be made within the default period required by applicable law, we may notify you of the delay and provide options including consent to delay or cancellation and refund as required. FTC guidance says sellers should have a reasonable basis for shipping claims and, if no shipment time is stated, generally should be able to ship within 30 days or follow delay/refund procedures.

SECTION 11 — RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, and exchanges are governed solely by our Refund Policy located at azuremist.us, which is incorporated into these Terms by reference.

For hygiene, health, and safety reasons, the Device and certain other items may be non-returnable once opened, used, or tampered with, except where the item is defective or where a return is required by law. Claims relating to defective, damaged, or non-functioning products will be handled in accordance with our Refund Policy and applicable law.

SECTION 12 — INTELLECTUAL PROPERTY

The Services, including but not limited to all text, graphics, logos, icons, images, audio, video, product descriptions, product names, designs, layouts, software, and the selection and arrangement thereof, are owned by Azuremist, its affiliates, licensors, or service providers and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, exploit, scrape, or otherwise use any content from the Services without our prior written consent.

Azuremist's names, logos, and branding are proprietary marks of Azuremist. You must not use them without our prior written permission. You should not interpret any reference in these Terms as a claim that Azuremist owns a federally registered trademark unless we expressly say so.

Shopify's name, logo, product names, service names, designs, and slogans are trademarks of Shopify. All other names, logos, product names, service names, designs, and slogans on the Services are the property of their respective owners.

SECTION 13 — OPTIONAL TOOLS

You may be provided with access to tools, services, content, or features offered by third parties. We neither monitor nor control these third-party tools and provide access to them on an "as is" and "as available" basis without warranties, representations, conditions, or endorsements of any kind.

Any use by you of optional third-party tools is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which such tools are provided by the relevant third-party provider.

We may also, in the future, offer new features, tools, or resources through the Services. Such new features, tools, or resources shall also be deemed part of the Services and subject to these Terms.

SECTION 14 — THIRD-PARTY LINKS

The Services may contain links to third-party websites, content, materials, or functionality. We do not control and are not responsible for examining or evaluating the content, accuracy, policies, or practices of any third-party sites or materials.

If you choose to access any third-party website or use any third-party service, you do so at your own risk. We are not liable for any harm, damage, or loss related to your access to, purchase from, or use of any third-party website, product, service, resource, or content.

SECTION 15 — RELATIONSHIP WITH SHOPIFY

Azuremist is powered by Shopify, which enables us to provide the Services to you. However, any sale or purchase you make in our store is made directly with Azuremist, not with Shopify.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Azuremist, including any injury, damage, loss, refund dispute, delivery issue, defect claim, or other claim arising from products or services purchased from Azuremist.

To the fullest extent permitted by law, you expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Azuremist.

SECTION 16 — PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy located at azuremist.us, which is incorporated into these Terms by reference.

Because the Services are hosted by Shopify, Shopify may process certain personal information to provide and improve the store infrastructure, checkout, and related services. Shopify's privacy materials explain that merchants and Shopify may each handle personal data in different roles depending on the service involved, so your own store Privacy Policy is important and should be read together with Shopify's privacy information.

By using the Services, you acknowledge that you have read our Privacy Policy and understand that information you provide may be processed by Azuremist, Shopify, and service providers acting on our behalf.

SECTION 17 — FEEDBACK AND REVIEWS

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, proposals, reviews, testimonials, photos, or other content to us or through the Services, you grant us a perpetual, worldwide, sublicensable, royalty-free, transferable license to use, reproduce, modify, adapt, publish, distribute, display, and otherwise use that content in any medium for any lawful purpose, including commercial and promotional purposes.

You represent and warrant that you own or control all rights in any content you submit, that the content is accurate, and that it does not violate these Terms or the rights of any third party.

We may, but are not obligated to, monitor, edit, remove, or refuse content we determine, in our sole discretion, to be unlawful, offensive, misleading, infringing, defamatory, abusive, obscene, or otherwise objectionable.

SECTION 18 — ERRORS, INACCURACIES, AND OMISSIONS

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times, availability, or other matters.

We reserve the right to correct any such errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Services is inaccurate at any time without prior notice, including after you have submitted your order.

SECTION 19 — PROHIBITED USES

You may access and use the Services only for lawful purposes. You may not use the Services, directly or indirectly:

for any unlawful, fraudulent, deceptive, abusive, or malicious purpose;
to violate any law, regulation, rule, or ordinance;
to infringe our rights or the rights of others;
to harass, defame, abuse, intimidate, threaten, or harm any person;
to transmit false or misleading information;
to send spam, phishing attempts, malware, or other harmful code;
to scrape, copy, extract, harvest, or collect data from the Services without authorization;
to use bots, crawlers, spiders, agents, automated systems, or similar methods to access the Services in a prohibited manner;
to interfere with, bypass, probe, or circumvent the security or operation of the Services;
or to engage in conduct that restricts or inhibits anyone else's use of the Services or may expose Azuremist, Shopify, or users to harm or liability.

We reserve the right to suspend, disable, restrict, or terminate access to the Services or any account if we believe these Terms have been violated.

SECTION 20 — AGENTS

This section applies if you use, permit, enable, or cause the deployment of any software, bot, crawler, autonomous system, or semi-autonomous system to access or interact with the Services.

Any such system must identify itself truthfully and must not conceal that it is automated. It may not mimic human activity to bypass controls, complete or evade CAPTCHAs, or circumvent measures intended to distinguish human from automated access.

We may restrict, block, condition, or technically limit whether and how automated systems access the Services at any time.

SECTION 21 — TERMINATION

We may terminate this agreement, your account, or your access to the Services, in whole or in part, at any time and in our sole discretion, without notice.

You remain liable for all obligations and amounts due up to and including the date of termination.

Any provisions that by their nature should survive termination will survive, including intellectual property, feedback, product safety, assumption of risk, warranty disclaimers, limitation of liability, indemnification, dispute provisions, governing law, and related provisions.

SECTION 22 — DISCLAIMER OF WARRANTIES

The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is strictly at your own risk.

Except as expressly stated by Azuremist in writing, and to the fullest extent permitted by law, the Services and all products offered through the Services, including the Device, are provided "as is" and "as available," without representations, warranties, or conditions of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement.

Without limiting the foregoing, and except as expressly stated by us in writing, we do not warrant any specific level of germ reduction, sterilization, disinfection, odor control, battery life, runtime, charge cycles, or water resistance, and we do not guarantee that any product will be suitable for every user's bathroom, preferences, or intended use.

We do not guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free.

Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

SECTION 23 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Azuremist, its owners, officers, directors, employees, affiliates, agents, contractors, service providers, licensors, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, arising out of or related to your use of the Services or any products purchased through the Services.

Without limiting the foregoing, and to the fullest extent permitted by law, Azuremist shall not be liable for damages, loss, or injury resulting from improper installation, improper mounting, misuse, abuse, unauthorized modification, improper charging, improper storage, water exposure, UV exposure caused by misuse, failure to follow instructions or warnings, use beyond intended design, intentional misconduct, negligence, or continued use after irritation, malfunction, discomfort, or damage becomes apparent.

To the fullest extent permitted by applicable law, our total aggregate liability for any claim arising out of or related to the Services or any product shall not exceed the amount you actually paid to us for the product giving rise to the claim.

However, nothing in these Terms is intended to exclude, waive, or limit rights or liabilities that cannot legally be excluded or limited under applicable law. UCC 2-719 specifically says that limitation of consequential damages for personal injury in the case of consumer goods is prima facie unconscionable, so this section is intended to apply only to the extent enforceable, and the limitations and exclusions above do not apply to liability that cannot lawfully be excluded or limited, including liability for personal injury to the extent the law does not permit its exclusion.

SECTION 24 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Azuremist, Shopify, and each of their affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, demands, losses, damages, liabilities, judgments, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

your breach of these Terms or any policy incorporated by reference;
your violation of any law or the rights of a third party;
your misuse of the Services or any product, including any unintended use of the Device or failure to follow its instructions and warnings;
or your negligent, reckless, fraudulent, or unlawful conduct.

We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with that defense.

SECTION 25 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, invalid, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.

SECTION 26 — WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with any policies or rules posted by us on the Services, constitute the entire agreement between you and Azuremist regarding your use of the Services and supersede any prior or contemporaneous agreements, communications, or proposals, whether oral or written.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

SECTION 27 — ASSIGNMENT

You may not assign, transfer, delegate, or otherwise convey these Terms or any rights or obligations under them without our prior written consent. Any attempted assignment in violation of this section is null and void.

We may assign, transfer, or delegate these Terms and our rights and obligations under them without notice to you.

SECTION 28 — GOVERNING LAW AND VENUE

These Terms and any dispute, claim, or controversy arising out of or relating to the Services, any order, any product, or these Terms shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to conflict of law principles.

You and Azuremist agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Henrico, Virginia, unless applicable law requires otherwise, and you consent to the jurisdiction and venue of those courts.

SECTION 29 — HEADINGS

The headings used in these Terms are included for convenience only and do not limit or otherwise affect these Terms.

SECTION 30 — CHANGES TO TERMS OF SERVICE

You can review the most current version of these Terms at any time on this page.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. Where required by applicable law, we will provide notice of material changes.

Your continued use of or access to the Services following the posting or effective date of any changes constitutes acceptance of those changes.
