We must receive and process payment before an order is accepted. Please review your order carefully before submitting it, as we may be unable to accommodate cancellation or modification requests after acceptance.

Delivery times are estimates only and are not guaranteed unless expressly stated otherwise by us in writing.

We are not responsible for shipping delays caused by carriers, weather, customs processing, supply disruptions, incorrect addresses, or events outside our reasonable control.

Title and risk of loss pass to you upon our transfer of the product to the carrier, to the extent permitted by applicable law.

If we advertise or communicate a shipping timeframe, we aim to have a reasonable basis for that estimate. If an order cannot be shipped within the promised time, or if no time is stated and shipment cannot be made within the default period required by applicable law, we may notify you of the delay and provide options including consent to delay or cancellation and refund as required. FTC guidance says sellers should have a reasonable basis for shipping claims and, if no shipment time is stated, generally should be able to ship within 30 days or follow delay/refund procedures.

Azuremist is powered by Shopify, which enables us to provide the Services to you. However, any sale or purchase you make in our store is made directly with Azuremist, not with Shopify.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Azuremist, including any injury, damage, loss, refund dispute, delivery issue, defect claim, or other claim arising from products or services purchased from Azuremist.

To the fullest extent permitted by law, you expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Azuremist.

By using the Services, you acknowledge that you have read our Privacy Policy and understand that information you provide may be processed by Azuremist, Shopify, and service providers acting on our behalf.

Without limiting the foregoing, and to the fullest extent permitted by law, Azuremist shall not be liable for damages, loss, or injury resulting from improper installation, misuse, abuse, unauthorized modification, improper storage, failure to follow instructions, use beyond intended design, intentional misconduct, negligence, or continued use after irritation, discomfort, or damage becomes apparent.

However, nothing in these Terms is intended to exclude, waive, or limit rights or liabilities that cannot legally be excluded or limited under applicable law. UCC 2-719 specifically says limitation of consequential damages for personal injury in the case of consumer goods is prima facie unconscionable, so this section is intended to apply only to the extent enforceable.

You agree to indemnify, defend, and hold harmless Azuremist, Shopify, and each of their affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any claims, demands, losses, damages, liabilities, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

your breach of these Terms or any policy incorporated by reference;
your violation of any law or the rights of a third party;
your misuse of the Services or any product;
or your negligent, reckless, fraudulent, or unlawful conduct.

We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with that defense.

These Terms and any dispute, claim, or controversy arising out of or relating to the Services, any order, any product, or these Terms shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to conflict of law principles.

You and Azuremist agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Henrico, Virginia, unless applicable law requires otherwise, and you consent to the jurisdiction and venue of those courts.
